Terms of Service

1. Acceptance of Terms

By accessing or using EcoScale ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. EcoScale is operated by EcoScale Technologies, a company incorporated under the laws of India, with its registered office in Hyderabad, Telangana.

2. Description of Service

EcoScale provides an AI-powered Kubernetes optimization platform that analyzes cluster metrics, provides intelligent recommendations, and optionally applies resource right-sizing autonomously. The Service is delivered as a cloud-based SaaS platform from our infrastructure.

3. User Responsibilities

As a user of the Service, you agree to:

• Provide accurate account and billing information
• Maintain the confidentiality of your API keys and credentials
• Use the Service in compliance with all applicable Indian and international laws
• Not reverse engineer, modify, or create derivative works of the Service
• Not use the Service to infringe on others' intellectual property rights
• Not attempt to disrupt or compromise the Service infrastructure

4. Service Level Agreement

EcoScale guarantees 99.9% uptime for paid plans, measured monthly. Enterprise plans receive 99.99% uptime SLAs. Service credits are issued for downtime exceeding these thresholds as per our SLA policy. Monitoring is performed from our Hyderabad operations center.

5. Data Handling & Privacy

EcoScale accesses only Kubernetes metrics and metadata through read-only Prometheus endpoints and the Kubernetes API. We do not access application data, database contents, or sensitive business logic. Data processing is governed by our Privacy Policy and complies with Indian IT Act 2000 and applicable data protection laws.

6. Payment Terms

Paid plans are billed monthly or annually in advance as per the pricing plan selected. All fees are non-refundable except as expressly stated in our cancellation policy. Pricing is subject to change with 30 days notice. All amounts are denominated in USD and are exclusive of applicable taxes, including GST for Indian customers.

7. Termination

Either party may terminate the agreement with 30 days written notice. Upon termination, your data will be retained for 90 days before permanent deletion. EcoScale reserves the right to suspend access for violation of these terms.

8. Limitation of Liability

EcoScale's total liability is limited to the amount paid for the Service in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or data loss, arising from use of the Service.

9. Governing Law & Jurisdiction

These terms are governed by the laws of India. Any disputes, claims, or controversies arising out of or relating to these terms shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India. The Indian Contract Act, 1872 and the Information Technology Act, 2000 shall apply.
